A separation agreement is an agreement between spouses who intend to separate and may be considering divorce. A separation agreement can establish each party’s obligations to pay expenses, maintain property or to handle other interim matters that may arise during separation. A marital settlement agreement, sometimes referred to as a postnuptial agreement, is an agreement entered into between spouses that resolves all of the property division, support and other issues associated with the dissolution of a marriage.
To be enforceable, these separation agreements must be in writing and, if properly done, will provide a road map for each party’s financial future. These agreements must be thoroughly and carefully prepared by a divorce attorney experienced in their drafting and negotiation.
